LEGISLATIVE CHANGES RAGARDING TRAFFICKING AND EXPLOITATION OF VULNERABLE PERSONS – EVOLUTION AND CURRENT JUSTIFICATIONS

The intensification of the phenomenon of exploitation of vulnerable people, the serious ways in which this phenomenon manifests itself, and its cross-border character have led the legislator to intervene on the normative content of some crimes regarding the trafficking and exploitation of vulnerable people in the current Criminal Code, by changing the amount of punishments and by introducing new assimilated variants and aggravating elements – the latest amendments were introduced by Law No. 217 of 10 July 2023, Law No. 202 of 26 June 2024, and Law No. 269 of 30 October 2024.
The justification for these legislative amendments referred to the high rate of human trafficking, the large number of children abused and sexually exploited by being forced into prostitution or into acts specific to child pornography, in the online environment, but also to the cross-border nature of human trafficking. Other reasons were also presented, such as: the significant proportion of other forms of exploitation (forced labor, begging); very lenient sentences compared to the seriousness of the crimes of trafficking and exploitation of vulnerable persons; the need to restrict the scope of application of the provisions on the suspension of the execution of the sentence under supervision in the case of slavery, human trafficking and minors trafficking; the lack of differences between the social danger of pimping in its aggravated form and human trafficking; non-uniform judicial practice.

The Criminal Code 2014. This Act was adopted by Law no. 286 of 17 July 2009 and published in the Official Gazette of Romania, Part I, no. 510 of 24 July 2009, subsequently undergoing several amendments and additions. It entered into force on 1 February 2014;
The Criminal Code 1969. This Act was adopted on 21 June 1968 and entered into force on 1 January 1969, being published in the Official Gazette no. 79-79 bis of 21 June 1968 and republished in 1973 and 1997;
The Criminal Code 1937. This Act was promulgated on 17 March 1936 and entered into force on 1 January 1937, later being rectified and amended. It was published in the Official Gazette on 18 March 1936 and republished on 19 January 1948.
The Criminal Code 1865. This Act was promulgated on 12 October 1864 and put into effect on 1 May 1865. It was published in the Official Gazette on 30 October 1864, later being amended several times and republished on 22 October 1912.
The Council of Europe Convention on Action against Trafficking in Human Beings was adopted on 3 May 2005, and was opened for signature in Warsaw, between 16 and 17 May 2005. The Convention was ratified by Romania by Law No. 300 of 11 July 2006.
The United Nations Convention against Transnational Organized Crime was adopted on 15 November 2000, in New York. The Convention was ratified by Romania by Law No. 565 of 16 October 2002.
Council Framework Decision of 19 July 2002 on combating trafficking in human beings (2002/629/JHA). This Framework Decision expired on 14 April 2011 and was replaced by Directive 2011/36/EU of the European Parliament and of the Council of the European Union.
Directive (EU) 2024/1712 of the European Parliament and of the Council of 13 June 2024 amending Directive 2011/36/EU on preventing and combating trafficking in human beings and protecting its victims. It was published in the Official Journal of the European Union L Series of 24 June 2024.
Directive 2011/36/EU of the European Parliament and of the Council of the European Union of 5 April 2011 on preventing and combating trafficking in human beings and protecting its victims, and replacing Framework Decision 2002/629/JHA of the Council of the European Union. It was published in the Official Journal of the European Union L101 of 15 April 2011.
Law no. 269 of 30 October 2024 amending and supplementing Law no. 286/2009 on the Criminal Code. This law was published in the Official Gazette no. 1089 of 31 October 2024.
Law no. 202 of 26 June 2024 amending and supplementing Law no. 286/2009 on the Criminal Code. This law was published in the Official Gazette no. 607 of 28 June 2024.
Law no. 217 of 10 July 2023 amending and supplementing Law no. 286/2009 on the Criminal Code, Law no. 135/2010 on the Criminal Procedure Code, as well as Law no. 504/2002 on Audiovisual, with subsequent amendments. This Act was published in the Official Gazette no. 634 of 11 July 2023.
Law no. 187 of 24 October 2012 implementing Law no. 286/2009 on the Criminal Code, as amended. This law was published in the Official Gazette no. 757 of 12 November 2012.
Law no. 678 of 21 November 2001 on preventing and combating trafficking in persons, as amended. This law was published in the Official Gazette no. 783 of 11 December 2001.
Emergency Ordinance no. 18 of 18 May 2016 amending and supplementing Law no. 286/2009 on the Criminal Code, Law no. 135/2010 on the Criminal Procedure Code, as well as supplementing art. 31 paragraph 1 of Law no. 304/2004 on judicial organization. This ordinance was published in the Official Gazette no. 389 of 23 May 2016.
Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime of 15 November 2000. The Protocol was ratified by Romania by Law no. 565 of 16 October 2002.
